On March 4, 2020 at 9 am, there will be a Preliminary Injunction Hearing at the US District Courthouse. 501 West 5th St, Austin.
We are not lawyers, but as we understand it, the Plaintiffs (City of Austin, City of San Marcos, Travis County, Hays County, Barton Springs Edwards Aquifer Conservation District, plus several individuals) are basically saying that appropriate consideration for the PHP route has not been made before permits were granted.
Kinder Morgan has been allowed to “slither through” the approval process on a technicality that should not have been allowed. It wasn’t done legally, according to plaintiffs.
BUT… you may say, they’ve already begun the construction/destruction process. Isn’t it too late to do anything?
And the answer to that is, whatever delay we can manage, costs Kinder Morgan more money, and helps us.
To that end, if you are able to attend this hearing, we’d love to have a great citizen representation in the Court. There will also be a vigil outside the Court, if you wish a more casual setting.
